These Terms and Conditions (“Terms”) govern your access to and use of **[LustSWIPE+]**, including our website, mobile applications, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree with them, you must not use the Service.
1. Eligibility
1.1. You must be at least **18 years old** to create an account or use the Service.

* you have legal capacity to enter into these Terms;
* the information you provide is accurate and not misleading;
* you will comply with all applicable laws and these Terms.

1.4. You may not create an account on behalf of another person without their authorization.
2. Account Registration
2.1. Certain features require you to create an account.
2.2. You must provide accurate, current and complete information and keep your information updated.
2.3. You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except where caused by our failure to provide appropriate security.
2.4. You must notify us promptly if you believe your account has been compromised or used without authorization.
2.5. Unless we expressly permit otherwise, you may maintain only one personal account.
3. Dating Profiles and User Content
3.1. The Service allows users to create profiles, upload photographs, write descriptions, exchange messages and otherwise submit content (“User Content”).
3.2. You remain the owner of your User Content.
3.3. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, technically modify, display and communicate that content solely to the extent necessary to operate, provide, secure and improve the Service.
3.4. You represent and warrant that:
* you own or have the necessary rights to submit the User Content;
* the User Content does not infringe another person’s intellectual property, privacy, image or other rights;
* the User Content is not unlawful, fraudulent or materially misleading;
* you have any necessary permission from persons depicted in photographs or other content.
3.5. You must not upload or distribute content that violates these Terms or applicable law.
4. Prohibited Conduct
You must not use the Service to:
* impersonate another person;
* create fake, deceptive or fraudulent profiles;
* harass, threaten, stalk, intimidate or abuse another person;
* engage in hate speech or discriminatory conduct;
* distribute sexually exploitative content or content involving minors;
* facilitate trafficking, exploitation or other criminal activity;
* solicit or distribute illegal goods or services;
* conduct scams, fraud, phishing or other deceptive activities;
* send spam or unsolicited commercial communications;
* distribute malware or attempt to compromise the Service;
* collect or misuse another user’s personal information without lawful grounds;
* publish another person’s private information without authorization;
* manipulate matching, ranking, reviews or other Service features through fraudulent means;
* use automated systems, scraping, bots or similar technologies without our authorization;
* use the Service for commercial purposes unless expressly permitted by us; or
* otherwise use the Service unlawfully or in a manner that materially harms other users or the Service.
5. User Safety
5.1. Dating involves interactions with people you may not know personally. You are responsible for exercising appropriate caution when communicating with or meeting other users.
5.2. We strongly recommend that you do not disclose sensitive personal information unnecessarily and that you take reasonable precautions before meeting another user offline.
5.3. Never send money, financial credentials, passwords, authentication codes or other sensitive information to another user solely because they request it.
5.4. If you believe another user poses a safety risk, is engaging in fraud or is violating these Terms, you should report them using the reporting mechanisms provided through the Service.
5.5. In emergencies or situations involving an immediate threat to safety, contact the appropriate emergency services rather than relying on the Service.
6. Content Moderation and Reporting
6.1. We may use a combination of automated systems and human review to detect, prevent and address unlawful content, fraud, abuse, spam, manipulation and violations of these Terms.
6.2. We may remove, restrict access to or otherwise moderate User Content where we have reasonable grounds to believe that it is unlawful or violates these Terms.
6.3. Where required by applicable law, we will provide users with information concerning moderation decisions and available remedies, including applicable complaint or appeal mechanisms.
6.4. Users may report content or accounts that they reasonably believe are unlawful or otherwise violate these Terms through **[reporting mechanism/link]**.
6.5. We may preserve or disclose information where required by law or where reasonably necessary to protect users, the public, our rights or the integrity of the Service.
7. Digital Services Act
7.1. Where applicable, the Service is subject to Regulation (EU) 2022/2065 (the “Digital Services Act”).
7.2. We will maintain mechanisms for reporting allegedly illegal content and will provide information and remedies required by applicable DSA provisions.
7.3. Where applicable, users may challenge certain content-moderation decisions through the internal complaint-handling mechanism made available by us.
7.4. Nothing in these Terms limits any mandatory rights or remedies available to consumers under applicable EU law.
8. Privacy and Personal Data
8.1. We process personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (Regulation (EU) 2016/679).
8.2. Our processing of personal data is described in our Privacy Policy.
8.3. Depending on the features you use, the Service may process information relating to your profile, preferences, communications, device, usage and interactions.
8.4. Where applicable, certain information relating to dating preferences or personal characteristics may constitute special categories of personal data. We will process such information only where an appropriate legal basis under applicable data protection law exists.
8.5. You should not provide another person’s personal information through the Service unless you have a lawful basis and are otherwise entitled to do so.
9. Communications
9.1. The Service may enable users to communicate with one another.
9.2. You are responsible for the communications and content you send.
9.3. We may apply technical and safety measures to communications where reasonably necessary to operate and protect the Service and where permitted or required by law.
9.4. We will not access private communications for unrelated purposes without an appropriate legal basis.
10. Matching and Recommendations
10.1. The Service may use algorithms, preferences and other signals to recommend profiles, matches or content.
10.2. Recommendations are intended to assist discovery and do not constitute a guarantee that another user is compatible with you or that you will receive a particular number of matches, messages or interactions.
10.3. We may modify or improve matching and recommendation systems over time.
10.4. Where required by applicable law, we will provide legally required information concerning the principal parameters used by recommendation systems.
11. Free and Paid Services
11.1. Some features may be available free of charge, while others may require payment.
11.2. Prices for paid features will be displayed before you purchase them.
11.3. Unless otherwise stated, prices include applicable VAT and other mandatory taxes where required by law.
11.4. Paid subscriptions may renew automatically if this is clearly disclosed before purchase. The applicable renewal period, price and cancellation conditions will be presented before you subscribe.
11.5. You may cancel an automatically renewing subscription in accordance with the cancellation procedure provided in the Service.
12. Consumer Withdrawal Rights
12.1. If you are a consumer in the European Union, you may have a statutory **14-day right of withdrawal** from a distance contract, subject to applicable legal exceptions.
12.2. If you expressly request that a digital service or digital content begin before the expiry of the withdrawal period, you acknowledge that specific legal consequences may apply.
12.3. Where applicable law provides an exception to the withdrawal right once digital content has been supplied with your express prior consent and acknowledgement, that exception may apply.
12.4. Nothing in these Terms is intended to exclude or reduce any mandatory consumer rights under applicable law.
13. Cancellation and Termination by You
13.1. You may stop using the Service at any time.
13.2. You may delete your account through **[account settings/process]**.
13.3. Deleting your account does not necessarily cancel a subscription purchased through a third-party app store. Where applicable, you must cancel the subscription through the relevant app store or payment provider.
13.4. Cancellation of a subscription does not automatically entitle you to a refund except where required by law or expressly provided by us.
14. Suspension and Termination by Us
14.1. We may suspend or terminate an account where reasonably necessary, including where:
* you materially breach these Terms;
* your conduct creates a safety or security risk;
* you engage in fraud or unlawful activity;
* you provide materially false information;
* we are required to do so by law; or
* continued provision of the Service is no longer reasonably possible.
14.2. Where required by applicable law, we will provide an explanation for a suspension, restriction or termination and information about available appeal mechanisms.
14.3. We may take immediate action where necessary to prevent serious harm, fraud, unlawful activity or security threats.
14.4. Termination does not affect rights or obligations that accrued before termination.
15. Intellectual Property
15.1. The Service, including its software, design, trademarks, logos, text, graphics and other materials, is owned by or licensed to us and is protected by applicable intellectual property laws.
15.2. Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, reverse engineer, sell, license or commercially exploit the Service or its content.
15.3. Nothing in these Terms transfers ownership of our intellectual property to you.
16. Third-Party Services
16.1. The Service may integrate with third-party services, including payment providers, authentication services, analytics providers and app stores.
16.2. Third-party services may be governed by their own terms and privacy policies.
16.3. We are not responsible for third-party services to the extent that they are outside our reasonable control, subject to mandatory legal rights.
17. Availability and Changes to the Service
17.1. We aim to provide a reliable Service but cannot guarantee uninterrupted or error-free operation.
17.2. We may modify, suspend or discontinue features where reasonably necessary for security, technical, legal, business or operational reasons.
17.3. Where a change materially affects a paid service or your contractual rights, we will provide any notice or remedies required by applicable law.
18. Liability
18.1. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
18.2. In particular, nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or other liability that cannot lawfully be excluded.
18.3. Subject to mandatory law, we are not responsible for:
* the conduct, identity, statements or actions of other users;
* relationships or interactions between users;
* content supplied by users;
* events occurring during offline meetings between users; or
* losses caused by circumstances outside our reasonable control.
18.4. The Service is a platform for facilitating connections. We do not guarantee that users are who they claim to be, that a match will result in a relationship, or that information provided by another user is accurate.
19. Indemnification
19.1. To the extent permitted by applicable law, you may be responsible for losses or claims suffered by us as a result of your unlawful use of the Service or your material breach of these Terms.
19.2. This clause does not apply to the extent that such liability would be prohibited or unfair under mandatory consumer protection law.
20. Complaints and Customer Support
20.1. Questions, complaints and support requests may be submitted through support@lustswipe.com.
20.2. We will handle complaints in accordance with applicable law and our internal procedures.
20.3. Nothing in this section prevents you from exercising any statutory consumer rights or pursuing remedies available under applicable law.
21. Alternative Dispute Resolution
21.1. Consumers may have access to mandatory or voluntary alternative dispute-resolution mechanisms depending on their country of residence.
21.2. Nothing in these Terms prevents a consumer from bringing proceedings before a competent court or exercising mandatory consumer rights.
22. Governing Law and Jurisdiction
22.1. These Terms are governed by the laws of **[Netherlands]**, except to the extent that mandatory consumer protection laws of your country of residence provide otherwise.
22.2. If you are a consumer residing in the European Union, you retain the benefit of mandatory provisions of the law applicable in your country of habitual residence where required by applicable law.
22.3. Nothing in these Terms deprives consumers of mandatory rights to bring proceedings before the courts available to them under applicable EU or national law.
23. Changes to These Terms
23.1. We may update these Terms from time to time.
23.2. If we make material changes, we will provide reasonable notice where required by law.
23.3. The updated Terms will identify the date on which they take effect.
23.4. Where applicable law requires your express consent to a material change, we will obtain that consent.
24. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or disregarded to the minimum extent necessary, and the remaining provisions will remain in effect.
